This Privacy Policy explains how MoodBoardly by Mr Bojli Kft. (“MoodBoardly”, “we”, “us”, or “our”) may collect, use, and disclose your personal information in connection with https://www.moodboardly.com and our other websites or digital properties that link to this Privacy Policy (collectively, the “Website”), our email communications, and other engagement through social media services, our surveys and promotions, and our related services (collectively with the Website, and the other activities described here, the “Service” or “Product”), and in certain offline scenarios.
Personal information MoodBoardly collects
The following are categories (with non-exhaustive examples) of personal information we may collect about you:
A. Individual Identifiers & Demographic Information Contact data, such as your name, address, phone number, or email address. Demographic data, such as general location information like city, state or geographic area.
B. Geolocation Data Precise location or geolocation data, when you authorize MoodBoardly to collect such information from your device when using the App.
C. Commercial Information Payment data, such as the information you may provide to make purchases (such as your payment method and credit or debit card number) or to receive payments as a Designer (such as your bank account number and routing number).
Profile and account data, such as your account name and password, the designers or clients you have contacted, order history, your reviews, products you have purchased (through affiliate links), and your design boards.
E. Internet or Network Activity Device data, such as your identifiers related to your phone, tablet, computer, or other device, operating system type and version number, manufacturer and model, browser type, screen resolution.
Online activity data, such as pages or screens you viewed, how long you spent on a page or screen, navigation paths between pages or screens, information about your activity on a page or screen, access times, and duration of access – Google Analytics F. Sensory Data Design images, such as the photos, images, product photos you may upload to your mood boards.
G. Inferences Drawn from Personal Information Profiles reflecting your preferences and other characteristics, such as inferences regarding your preferences when using the Services and other characteristics about your interactions with us that we may combine with other personal information we collect about you as described in this table.
How MoodBoardly collects your information
We collect information about you in various ways, including in connection with the sources described below.
Personal Information You Provide. We collect personal information you provide to us, such as when you register to use the Service, make a purchase, publish a mood board, or complete an application to become a MoodBoardly designer.
Business Partners and Other Third Parties. We may also collect information about you from our business partners, social media networks and data providers, and we may add that information to information you provide to us and other personal information we collect.
Social Media Platforms. If you are a Client, you may register using a social network, such as Facebook or Pinterest. We collect information from the social network when you use your social media credentials to log into the Service. For example, when you log in with your Facebook credentials, we may collect the information you have made publicly available on Facebook/Google, such as your name and profile picture.
Location Information from Your Mobile Device. We may collect and store your location information if you enable your mobile device to send it to us. Collection of this information may improve the provision of the Service.
Automatic Data Collection, Cookies, and Related Technologies. The Service collects and stores information that is generated automatically as you use it, including your preferences and anonymous usage statistics. We, our service providers, and our business partners may automatically log personal information about you, your computer or device, and your activity over time on our Service and other sites and services, such as identifiers, device data, online activity data, and geolocation data, including by using cookies and similar technology. Like many online services, the Service may use the following technologies to facilitate our automatic data collection:
o Cookies, which are small text files placed in visitors' computer browsers to store their preferences, make navigation between pages more efficient, help us understand user activity and patterns, and facilitate online advertising.
o Web beacons, also known as pixel tags or clear GIFs, which are typically used to demonstrate that a webpage or email was accessed or opened, or that certain content was viewed or clicked, typically to compile statistics about usage of websites and the success of marketing campaigns.
o Software development kits, or SDKs, which are third-party computer code used in connection with our App for a variety purposes, including to provide us with analytics regarding the use of our App, to integrate with social media, add features or functionality to our App, or to facilitate online advertising. SDKs may enable third parties to collect information directly via our App.
How MoodBoardly uses your personal information
Service Delivery. We use information to deliver our Service, including but not limited to:
o provide, support, personalize, and develop our Service, products, and services;
o fulfill or meet the reason you provided the information. For example, if you share your name and contact information to ask a question about our products or services, we will use that personal information to respond to your inquiry. If you provide your personal information to purchase a product or service, we will use that information to process your payment and facilitate delivery;
o facilitate new product orders or process returns;
o post your reviews, feedback, or stories to MoodBoardly
o process your requests, purchases, transactions, and payments;
o create, maintain, customize, and secure your account with us;
o provide you with support and to respond to your inquiries, including to investigate and address your concerns and monitor and improve our responses;
o personalize your Service experience; and communicate with you regarding administrative, informational, and operational purposes, such as to send you emails relating to account management, customer service, or system maintenance.
Marketing. We and our partners may use your personal information for direct marketing and interest-based advertising purposes.
o Direct Marketing. We may use information (including your email) to provide online advertising on the Service and to facilitate transmittal of information that may be useful, relevant, valuable, or otherwise of interest to you. This may be information about our products and services or third-party products and services.
o Interest-Based Advertising. We also contract with our business partners, third-party advertising companies, and social media companies to display ads on our Service and other sites and services. These companies may use cookies and similar technologies to collect information about you (including the device data and online activity data described above) over time across our Service and other sites and services or your interaction with our emails and use that information to serve ads that they think will interest you. Research and Development. We may use your personal information for testing, research, analysis, and product development, including to develop and improve our Service, products, and services and to create new products and services. o enforce the terms and conditions that govern the Service; and
o prevent, identify, investigate, and deter fraudulent, harmful, unauthorized, unethical, or illegal activity, including cyberattacks and identity theft.
Other Uses. In addition to the uses otherwise described in this Privacy Policy, we may also use your personal information as described to you at the time when we collect it.
Sharing your Personal Information
MoodBoardly may disclose your personal information to a third party for a business purpose. When we disclose personal information for a business purpose, we enter into a contract that describes the purpose and requires the recipient to both keep that personal information confidential and not use it for any purpose except performing the contract. We also take reasonable measures to ensure that these third parties provide sufficient guarantees to implement appropriate technical and organizational measures.
We share your personal information with the following categories of third parties:
1. Service providers such as Paddle who will utilize your credit card and other payment information in accordance with their respective privacy policies. Check out their privacy policy hier.
2. Related Companies: We use the affiliate programs "AWIN", “Papperjam”, or “CJ Affiliate” within the framework of them, conversion tracking. The purpose of tracking is to assign a publisher's sales to a precise user transaction so that we, as MoodBoardly, can remunerate the publisher for his transaction. "AWIN", “Papperjam”, or “CJ Affiliate” cannot identify who the user is, but only that the same user started his journey with a publisher and finished it with MoodBoardly as the advertiser. By creating a restricted user profile that does not contain the name or identity of the user, "AWIN", “Papperjam”, or “CJ Affiliate” is also able to detect the so-called "user journey" when it starts on one device and ends on another device. The profile will only be used to assign sales and marketing efforts to a publisher, even if the user has changed devices before completing a transaction. 3. Google Analytics We use a tool called “Google Analytics” to collect information about use of this site. Google Analytics collects information such as how often users visit this site, what pages they visit when they do so, and what other sites they used prior to coming to this site. We use the information we get from Google Analytics only to improve this site. Google Analytics collects only the IP address assigned to you on the date you visit this site, rather than your name or other identifying information. We do not combine the information collected through the use of Google Analytics with personally identifiable information. Although Google Analytics plants a permanent cookie on your web browser to identify you as a unique user the next time you visit this site, the cookie cannot be used by anyone but Google. Google’s ability to use and share information collected by Google Analytics about your visits to this site is restricted by the Google Analytics Terms of Use (as amended for government websites) and the Google Privacy Policy. You can prevent Google Analytics from recognizing you on return visits to this site by disabling cookies on your browser.
4. Google AdWords remarketing
We use Google Analytics’ 3rd-party audience data such as age, gender, and interests to better understanding the behavior of our customers and work with companies that collect information about your online activities to provide advertising targeted to suit your interests and preferences. For example, you may see certain ads on this website or other websites because we contract with Google and other similar companies to target our ads based on information we or they have collected, including information that was collected through automated means (such as cookies and web beacons). These companies also use automated technologies to collect information when you click on our ads, which helps track and manage the effectiveness of our marketing efforts.
You may opt out of the automated collection of information by third-party ad networks for the purpose of delivering advertisements tailored to your interests, by visiting the consumer opt-out page for the Self-Regulatory Principles for Online Behavioral Advertising at http://www.aboutads.info/choices/ and edit or opt-out your Google Display Network ads’ preferences at http://www.google.com/ads/preferences/.
5. Facebook, Custom Audiences and Facebook Marketing Services
Due to our legitimate interest in the analysis, optimization and economic operation of our online offer and for these purposes within the meaning of Art. 6 (1) f. of the GDPR we use the so-called "Facebook pixel" of the social network Facebook, which is operated by Facebook Inc., 1 Hacker Way, Menlo Park, CA 94025, USA, or if you are a resident of the EU, Facebook Ireland Ltd., 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland ("Facebook").
Facebook is certified under the Privacy Shield Agreement and thereby offers a guarantee to comply with European data protection law.
With the help of the Facebook pixel, Facebook is on the one hand able to determine the visitors of our online offer as a target group for the presentation of advertisements (so-called "Facebook ads"). Accordingly, we use the Facebook pixel to display our Facebook ads only to Facebook users who have shown an interest in our website or who have specific characteristics (e. g. interests in certain topics or products determined by the websites visited) that we submit to Facebook (so-called "custom audiences"). With the help of the Facebook pixel, we also want to make sure that our Facebook ads are in line with the potential interest of users and do not have a nuisance effect. Using the Facebook pixel, we can also track the effectiveness of Facebook ads for statistical and market research purposes by seeing whether users have been redirected to our website after clicking on a Facebook ad (so-called "conversion tracking").
The Facebook pixel is directly integrated into our website by Facebook and can store a so-called cookie, i. e. a small file, on your device. If you then log in to Facebook or visit Facebook when you are logged in, your visit to our online offer will be noted in your profile. The data collected about you is anonymous for us, i. e. it does not allow us to draw conclusions about the identity of the users. However, the data is stored and processed by Facebook so that it can be linked to the respective user profile and used by Facebook as well as for its own market research and advertising purposes. If we transfer data to Facebook for comparison purposes, it is encrypted locally in the browser and only then sent to Facebook via a secure https connection. This is done with the sole purpose of matching the data encrypted by Facebook.
Furthermore, when using the Facebook pixel, we use the additional function "advanced matching", in which inventory data such as telephone numbers, e-mail addresses or users' Facebook IDs is transmitted to Facebook (encrypted), but solely to create target groups ("Custom Audiences"). Users agree our use of the "advanced matching" and the related processing of their data.
Based on our legitimate interests, we also use the "Custom Audiences from File" function of the social network Facebook, Inc. in which case inventory data (phone numbers, email addresses, Facebook IDs) will be uploaded to Facebook. The upload process is encrypted. The upload serves solely to identify recipients of our Facebook ads. We want to ensure that the ads are only displayed to users who are interested in our information and services. Users agree our use of the " Custom Audiences from File" function and the related processing of their data.
Facebook's processing of the data is governed by Facebooks Data Usage Policy. Accordingly, general instructions on how to display Facebook ads, in the Facebook Data Usage Policy: https://www.facebook.com/policy.php. You may object to the collection by the Facebook pixel and use of your data to display Facebook ads. To set what kind of ads you see on Facebook, you can go to the page set up by Facebook and follow the instructions on how to set up use-based advertising: https://www.facebook.com/settings?tab=ads. The settings are platform-independent, i. e. they are applied to all devices, such as desktop computers or mobile devices.
6. Merger, Sale, or Other Asset Transfers. If we are involved in a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, sale of company assets, or transition of service to another provider, including any related negotiations, your information may be sold, disclosed, or transferred as part of such a transaction (or potential transaction). If another company acquires our company or our assets, that company will possess the information collected by it and us and will assume the rights and obligations regarding your information collected by us as described in this policy.
Security of your information
We take steps to ensure that your information is treated securely and in accordance with this Privacy Policy. Unfortunately, the Internet cannot be guaranteed to be 100% secure, and we cannot ensure or warrant the security of any information you provide to us. We do not accept liability for unintentional disclosure.
By using the MoodBoardly tool or providing information to us, you agree that we may communicate with you electronically regarding security, privacy, and administrative issues relating to your use of the Service.
Your choices
You can make the following choices with respect to your personal information.
Opt-Out of Marketing Communications. You may opt out of marketing-related emails by following the opt-out or unsubscribe instructions at the bottom of the email, or by contacting us at [email protected]. You may continue to receive service-related and other non-marketing emails.
Third Party Platforms. If you choose to connect to the Service using a third party platform like Facebook/Goole, you may be able to use your settings in your account with that platform to limit the information we receive from it. If you revoke our ability to access information from a third party platform, that choice will not apply to information that we have already received from that third party.
Cookies. Most browsers let you remove and/or stop accepting cookies from the websites you visit. To do this, follow the instructions in your browser’s settings. Many browsers accept cookies by default until you change your settings. If you do not accept cookies, however, you may not be able to use all functionality of the Service and our Site may not work properly. International transfers of personal information
Mr Bojli Kft is based in Hungary. If you are from a country outside of Hungary with laws governing data collection, use, and disclosure that may differ from Hungary law and you provide personal information to us, please note that any personal information that you provide to us may be transferred to Hungary. By providing your personal information, where applicable law permits, you hereby specifically and expressly consent to such transfer and processing and the collection, use, and disclosure set forth herein or in any applicable terms of service.
Changes to our Privacy Policy
MoodBoardly reserves the right to amend this Privacy Policy at our discretion and at any time. When we make changes to this Privacy Policy, we will post the updated notice on the Site and update the “Last Updated” date above. Your continued use of the Service following the posting of changes constitutes your acceptance of such changes.
